Terms of Service

1. Acceptance of Terms

By accessing or using The Transfer Portal ("the App," "the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and The Transfer Portal.

If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or by sending you a notification. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

Please also review our Privacy Policy, which describes how we collect, use, and share your information.

2. Eligibility

To use The Transfer Portal, you must:

  • Be at least 18 years of age
  • Be legally capable of entering into a binding contract in your jurisdiction
  • Not be prohibited from using the Service under applicable laws or regulations
  • Not have been previously banned or removed from the Service
  • Not be a registered sex offender in any jurisdiction

By using the Service, you represent and warrant that you meet all of these eligibility requirements. We reserve the right to verify your eligibility and refuse service at our discretion.

3. Your Account

3.1 Account Creation

To use the Service, you must create an account. You may register using your email address or by signing in through a supported third-party provider such as Google, Apple, or Facebook. You agree to provide accurate, current, and complete information during the registration process and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

3.3 One Account Per Person

Each person may only maintain one active account on The Transfer Portal. Creating multiple accounts is a violation of these Terms and may result in the suspension or termination of all associated accounts.

3.4 Account Deletion

You may delete your account at any time through the Settings page in the App. Upon deletion, your profile will be removed from the Service. Please note that some information may be retained as described in our Privacy Policy, including data required for legal or regulatory compliance.

4. Using the Service

4.1 Purpose

The Transfer Portal is a dating platform designed for divorced and separated singles who are serious about finding meaningful relationships. The Service is intended for personal, non-commercial use only. You may not use the Service for advertising, solicitation, or any commercial purpose without our prior written consent.

4.2 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to sublicense, modify, distribute, sell, or create derivative works based on the Service or its content.

4.3 Emotional Readiness Assessment

The Transfer Portal includes an emotional readiness assessment feature designed to help users reflect on their preparedness for a new relationship. This feature is provided for informational and self-reflection purposes only. It is not a substitute for professional counseling, therapy, or mental health treatment. We do not provide medical or psychological advice, and you should consult a qualified professional for such guidance.

4.4 Location Services

The Service uses location data to show you potential matches in your area. By using the Service, you consent to the collection and use of your location information as described in our Privacy Policy. You can manage location permissions through your device settings, though disabling location services may limit the functionality of the App.

4.5 Communications Between Users

The Transfer Portal provides messaging and communication features to help users connect. You are solely responsible for the content of your communications with other users. We do not monitor or pre-screen messages, but we reserve the right to review and remove content that violates these Terms or our Community Guidelines.

4.6 Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law or regulation
  • Impersonate any person or entity or misrepresent your identity, affiliation, or age
  • Harass, threaten, intimidate, stalk, or abuse any other user of the Service
  • Post or transmit any content that is defamatory, obscene, hateful, or otherwise objectionable
  • Use the Service to solicit money, goods, or services from other users
  • Send spam, chain letters, or unsolicited promotional materials to other users
  • Use automated means, including bots, scrapers, or crawlers, to access or collect data from the Service
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems and networks
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Upload or transmit viruses, malware, or any other malicious code
  • Interfere with or disrupt the Service or servers and networks connected to the Service
  • Use the Service for any commercial purpose, including advertising or selling products or services
  • Create or use a false identity or provide misleading information for the purpose of deceiving others
  • Share your account or login credentials with any third party

5. Community Guidelines

5.1 Be Authentic

Use your real name and provide accurate information about yourself. Upload recent photos that clearly show your face. Complete our photo verification process to build trust with other users. Misrepresenting yourself undermines the community and may result in account removal.

5.2 Be Respectful

Treat all users with dignity and respect. Respect the boundaries and preferences of others. Accept that not every interaction will lead to a connection, and handle rejection gracefully. Discriminatory behavior based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic will not be tolerated.

5.3 Be Safe

Report any suspicious or inappropriate behavior to our team. Do not share sensitive financial information, such as bank account numbers or credit card details, with other users. Be cautious when sharing personal information such as your home address or workplace. Review our safety tips before meeting someone in person.

5.4 Zero Tolerance

The Transfer Portal maintains a zero tolerance policy for the following behaviors, which will result in immediate account termination:

  • Sexual harassment: Unwanted sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature
  • Non-consensual images: Sharing or threatening to share intimate or sexual images of another person without their consent
  • Violence and threats: Threatening or encouraging violence against any individual or group
  • Exploitation: Attempting to exploit, manipulate, or scam other users, including financial exploitation
  • Hate speech: Content or behavior that promotes hatred or discrimination against individuals or groups based on protected characteristics
  • Interactions with minors: Any attempt to contact or engage with individuals under the age of 18 through the Service

6. Content & Intellectual Property

6.1 Your Content

You retain ownership of any content you submit, post, or display on or through the Service ("Your Content"). By submitting Your Content, you grant The Transfer Portal a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute Your Content in connection with operating and promoting the Service. This license continues until your content is deleted from the Service, except that content shared with other users may remain visible to them after deletion.

6.2 Content Standards

All content you submit must comply with these standards:

  • No nudity or sexually explicit material: Profile photos and content must be appropriate for a general audience
  • No violence or graphic content: Do not post images or content depicting violence, gore, or other disturbing material
  • No contact information in restricted fields: Do not include phone numbers, email addresses, social media handles, or website URLs in your profile bio or photo captions
  • No photos of minors: Do not upload photos that prominently feature children or minors, whether alone or with you

We reserve the right to remove any content that violates these standards or is otherwise objectionable, at our sole discretion and without prior notice.

6.3 Our Intellectual Property

The Service, including its design, features, content, trademarks, logos, and all related intellectual property, is owned by The Transfer Portal and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

6.4 Feedback

If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use, modify, and incorporate such Feedback into the Service without any obligation to you. You acknowledge that Feedback is not confidential and that we are free to use it for any purpose.

7. Subscriptions & Payments

7.1 Free Features

The Transfer Portal offers a set of free features that allow you to create a profile, browse potential matches, and use basic functionality. Some features require a paid subscription to access.

7.2 Premium Subscriptions

We offer premium subscription tiers, including Premium and Premium Plus, which provide access to enhanced features such as unlimited likes, advanced filters, priority visibility, and more. Details of each subscription tier, including pricing and included features, are available within the App.

7.3 Payment Processing

All payments are processed through the Apple App Store or Google Play Store, depending on your device platform. By purchasing a subscription, you agree to the payment terms and conditions of the applicable app store. We do not directly collect or store your payment information.

7.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually, depending on your selected plan) unless you cancel before the renewal date. The renewal charge will be applied to your payment method on file with the applicable app store within 24 hours prior to the end of the current billing period.

7.5 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period, and you will continue to have access to premium features until that time. Canceling does not entitle you to a refund for the current billing period.

7.6 Price Changes

We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of your next billing period following notice of the change. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

7.7 Refunds

Refund requests are handled by the Apple App Store or Google Play Store in accordance with their respective refund policies. We generally do not offer refunds for partial subscription periods or unused features. Exceptions may apply where required by applicable law.

8. Virtual Items & Premium Features

8.1 Virtual Items

The Service may offer virtual items such as boosts, super likes, or other premium features ("Virtual Items"). Virtual Items have no monetary value and cannot be redeemed for cash, refunded, or transferred to other users or accounts. Virtual Items are a limited license, not a purchase of property, and may be modified or removed at our discretion.

8.2 Feature Availability

Premium features and Virtual Items may vary by region, device, or subscription tier. We reserve the right to modify, suspend, or discontinue any feature at any time without prior notice. We will make reasonable efforts to notify users of significant changes to premium features.

8.3 Explore Mode

Explore Mode is a premium feature that allows you to expand your search radius up to 150 miles or browse singles in nearby cities when you have exhausted local matches. Explore Mode availability and functionality may vary based on your subscription tier and location. Matches made through Explore Mode are subject to the same Terms and Community Guidelines as all other matches.

9. Safety & Interactions

9.1 No Background Checks

The Transfer Portal does not conduct criminal background checks on its users. We do not verify the criminal history, identity, or background of users beyond the verification features described below. You are solely responsible for taking appropriate precautions when interacting with other users, both online and in person.

9.2 Photo Verification

We offer a pose-based photo verification system designed to help confirm that the person in a user's profile photos matches the person using the account. Photo verification is an optional trust-building tool and is not a guarantee of identity. Verified badges indicate that a user has completed the verification process, not that the user has been background-checked or vetted in any other way.

9.3 ID Verification

We may offer optional ID verification to provide an additional layer of trust. If available, ID verification allows users to submit a government-issued identification document for review. ID verification is voluntary and is intended to supplement, not replace, your own judgment and safety precautions.

9.4 Reporting & Blocking

You can report or block other users at any time through the App. Reports are reviewed by our team and may result in warnings, temporary suspensions, or permanent bans depending on the severity of the violation. We take all reports seriously and will investigate promptly. Abusing the reporting feature to make false or malicious reports is a violation of these Terms.

9.5 Voice & Video Calls

The Service offers voice and video calling features powered by Agora. Calls are conducted in real-time and are not recorded by The Transfer Portal. You agree to use calling features in accordance with these Terms and Community Guidelines. We are not responsible for the content of calls between users.

9.6 In-Person Meetings

If you choose to meet another user in person, you do so at your own risk. We strongly recommend the following safety tips:

  • Meet in a public place for your first several dates
  • Tell a friend or family member about your plans, including where you are going and who you are meeting
  • Arrange your own transportation to and from the meeting
  • Keep your phone charged and accessible throughout the date
  • Trust your instincts and leave immediately if you feel uncomfortable or unsafe

The Transfer Portal is not responsible for the conduct of any user, whether online or offline.

10. Termination & Suspension

10.1 Termination by You

You may terminate your account at any time by deleting it through the Settings page in the App. If you have an active subscription, please cancel it through your app store settings before deleting your account to avoid further charges.

10.2 Termination by Us

We reserve the right to suspend or terminate your account at any time and for any reason, including but not limited to violations of these Terms, our Community Guidelines, or applicable law. We may also terminate accounts that have been inactive for an extended period. Where practical, we will provide notice before termination, but we are not obligated to do so in cases of serious or repeated violations.

10.3 Effect of Termination

Upon termination of your account:

  • Your right to access and use the Service will immediately cease
  • Your profile and content will be removed from the Service, subject to our data retention policies
  • Any unused Virtual Items, remaining subscription time, or other benefits will be forfeited and will not be refunded
  • Provisions of these Terms that by their nature should survive termination will remain in effect, including Sections 6, 11, 12, 13, and 14

10.4 Appeals

If you believe your account was suspended or terminated in error, you may contact us at support@thetransferportal.com to request a review. We will investigate your appeal and respond within a reasonable timeframe. Our decision on appeals is final.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TRANSFER PORTAL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT MAKE ANY WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT MADE AVAILABLE THROUGH THE SERVICE, INCLUDING USER PROFILES, PHOTOS, AND COMMUNICATIONS. YOUR USE OF THE SERVICE AND ANY INTERACTIONS WITH OTHER USERS ARE AT YOUR OWN RISK.

THE TRANSFER PORTAL DOES NOT REPRESENT OR WARRANT THAT THE SERVICE WILL RESULT IN ANY MATCHES, CONNECTIONS, OR RELATIONSHIPS. WE ARE NOT RESPONSIBLE FOR THE BEHAVIOR, ACTIONS, OR INACTIONS OF ANY USER, WHETHER ONLINE OR OFFLINE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE TRANSFER PORTAL, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO THE TRANSFER PORTAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY EVEN IF THE TRANSFER PORTAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless The Transfer Portal, its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms or any applicable law or regulation
  • Your Content or any content you submit, post, or transmit through the Service
  • Your interactions with other users, whether online or offline
  • Any claim by a third party that your use of the Service or Your Content infringes their intellectual property or other rights

14. Dispute Resolution

14.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at support@thetransferportal.com. We will attempt to resolve the dispute through good-faith negotiation within 60 days. If the dispute cannot be resolved informally, either party may proceed with formal dispute resolution as described below.

14.2 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service that cannot be resolved through informal resolution shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator in the state where you reside or another mutually agreed-upon location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14.3 No Class Actions

YOU AND THE TRANSFER PORTAL AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

14.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

14.5 Time Limitation

You agree that any cause of action arising out of or related to the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and The Transfer Portal regarding the Service. These Terms supersede all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether written or oral, between the parties regarding the subject matter herein.

15.2 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by The Transfer Portal.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.

15.5 Third-Party Services

The Service may contain links to or integrations with third-party websites, services, or applications that are not owned or controlled by The Transfer Portal. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and conditions of those services.

15.6 Force Majeure

The Transfer Portal shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, pandemics, government actions, power failures, internet disruptions, or other force majeure events.

15.7 Notices

We may send you notices through the App, by email to the address associated with your account, or by other reasonable means. You are responsible for keeping your contact information current. Notices sent by email are deemed received when sent. You may send notices to us at support@thetransferportal.com.
